Abstract
El propósito fundamental del estudio es valorar si realmente un menor de edad tiene capacidad suficiente para tomar decisiones personales en el ámbito sanitario. La situación se torna compleja cuando un menor de edad por diversos y variados motivos declina un tratamiento médico al entender, según su parecer, que el procedimiento atenta a su ideario. Ante dicha disyuntiva, cada vez más común en los centros hospitalarios, analizaremos el derecho sustantivo y procesal que asiste a los pacientes menores de edad. De igual forma, citaremos parte de la abundante jurisprudencia española en relación tanto a la capacidad como a los derechos ampliamente reconocidos a los pacientes menores de edad.

| Resumen en otro Idioma | The primary purpose of the study is to assess whether a minor really has sufficient capacity to make its own decisions in the health field. The situation becomes complex when a minor, for various and varied reasons, refuses to undergo medical treatment on the basis of his or her opinion that the procedure is attentive to his or her ideas. Faced with this dilemma, which is becoming increasingly common in hospitals, we will analyse the substantive and procedural law that assists minor patients. Similarly we will cite part of the abundant Spanish jurisprudence regarding both the capacity and the rights recognized to minor patients. |
