dc.description.abstractExiste un gran vacío en la Ley de Propiedad Industrial venezolana (1955) en el tratamiento de la oposición por mejor derecho, que contiene una fase administrativa y otra jurisdiccional. El contenido de la Ley citada da origen a interpretaciones erróneas, acerca de cual es el correcto procedimiento a seguir en ambas sedes e, incluso, cual debe ser la correcta actuación tanto del Registrador como del Juez Civil. Este trabajo pretende aclarar los diferentes institutos jurídicos involucrados, y los procedimientos que deben aplicarse, muchos de los cuales no están previstos en la Ley.es_VE

dc.description.abstract1There is a gaping void in Venezuela’s Industrial Property Law (1955) in the matter of opposition based on better right, which comprises both an administrative and a jurisdictional phase. The aforementioned law’s contents lead to erroneous interpretations as to the correct procedural steps to be followed on those phases, as well as to the proper course of action for both Registrar and Civil Judge. This work intends to clarify the role of the different juridical institutions involved and the procedures to be followed, many of which are not provided in the Law.es_VE
