Abstract
Existe un gran vacío en la Ley de Propiedad Industrial venezolana (1955) en el tratamiento de
la oposición por mejor derecho, que contiene una fase administrativa y otra jurisdiccional. El
contenido de la Ley citada da origen a interpretaciones erróneas, acerca de cual es el correcto
procedimiento a seguir en ambas sedes e, incluso, cual debe ser la correcta actuación tanto del
Registrador como del Juez Civil. Este trabajo pretende aclarar los diferentes institutos jurídicos
involucrados, y los procedimientos que deben aplicarse, muchos de los cuales no están previstos
en la Ley.
