Abstract
El presente artículo pone de presente
la pugna entre la codificación y la jurisprudencia
en Alemania y Francia durante
el siglo XIX, pertinente en el trasplante del
código civil en Colombia y la lucha que aún
se ve en las altas cortes desde que la Corte
Constitucional le ha dado fuerza vinculante
a la jurisprudencia.
