dc.description.abstract | Se presenta un trabajo relacionado con la Ley del Estatuto de la Función Pública que
sorpresivamente y sin antecedente histórico dejó atrás la práctica legal donde los Estados
Federados y los Municipios dictasen sus propios instrumentos normativos mediante sus Asambleas
Legislativas y luego sus Consejos Legislativos, o de sus Cámaras Municipales y los Concejos,
para regular el ámbito sustantivo, orgánico y competencial de sus relaciones de empleo público
desarrolladas en sus específicas esferas territoriales. Lo anterior resta considerablemente las
competencias de los municipios en el Estado venezolano. Sin embargo, ninguno de los 335
Municipios y 23 Estados Federados opuso resistencia a tal situación, ya que sus respectivos
órganos legislativos no reivindicaron sus competencias normativas en materia de función pública,
al no plantearse un instrumento jurídico que eventualmente pudiese plantear el conflicto

precedent has left behind the legal practice where the federal states and municipalities are
able to dictate its own legal instruments through their legislatures and then its Legislative
Councils to regulate the substantive, organizational and competence of public employment
relationships developed in their specific fields territorial scope .This reducessignificantly
the powers of the municipalities in the Venezuelan state. However, none of the 335
municipalities and 23 federal states resisted such a situation, since their respective
legislative bodies not claimed their regulatory responsibilities for public service, not
