Abstract
Tras la entrada en vigencia del Acuerdo relativo a los Aspectos de los Derechos de Propiedad Intelectual relacionados con el
Comercio (ADPIC, 1994), el sistema de protección de estos derechos ha sido objeto de un fortalecimiento inimaginable en el
pasado. El impacto de dicha normativa en el desarrollo de los pueblos merece ser objeto de análisis. A tal efecto es necesario determinar si los beneficios son equitativos y constituyen a disminuir la brecha entre países desarrollados y países en desarrollo en tiempos en los que la economía está determinada por el saber, no solo en cuanto a saber, sino en cuanto esté protegido mediante derechos de propiedad intelectual. Este estudio da cuenta del proceso de fortalecimiento, sus mecanismos, impacto, ventajas y desventajas, así como de la experiencia de algunos países en la materia, especialmente Japón, China y Colombia.

| Resumen en otro Idioma | Following the entry into force of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS, 1994), the protection of intellectual property right has been strengthened. The impact of such regulation towards the development of nations is worth of analysis. Our study intends to establish if the benefits of the Intellectual Property System of Protection are fair and contribute to reduce the gap between developed, developing countries and transitional economies. These is important considering that the world economy is determined not only by knwledge but from its protection under Intellectual Property rights. This study shows the process and mechanisms strengthening Intellectual Property right, its impact, advantages and disadvantages, as well as the analysis of the experience gaines by some countries, mainly Japan, China and Colombia. |
