El nombre comercial: protección en el derecho venezolano y en el derecho comunitario andino

Abstract
El autor da una visión general sobre la protección del «Nombre Comercial» en la Comunidad Andina de Naciones (CAN) y en Venezuela, mediante el estudio del Convenio de París para la Protección de la Propiedad Industrial; de la Decisión 486 de la Comisión de la CAN (D486) -Régimen Común sobre Propiedad Industrial-; y de la Ley de Propiedad Industrial. Revisa las decisiones más relevantes del Tribunal de Justicia de la CAN (TJCAN) sobre el tema, y hace consideraciones críticas sobre la posición del Registro de la Propiedad Industrial, en relación con los «servicios de venta al detal», pues la oficina interpreta que la protección que corresponde a estos servicios es la del Nombre Comercial, aunque la tendencia internacional es la protección como marca de servicio.

Resumen en otro IdiomaThe author gives an overview of the protection of the «Trade Name» in the Andean Community of Nations (CAN) and in Venezuela, through the study of the Paris Convention for the Protection of Industrial Property; of the Decision 486 of the Commission of the CAN (D486)-Common Regime of Industrial Property-; and of the Industrial Property Law. He reviews the most relevant decisions of the CAN´s Court of Justice (TJCAN) regarding the topic, y and he makes critical remarks of the position of the Industrial Property Registry regarding «Retail Services», due to this office’s interpretation that these services must be protected as «Trade Names», in spite of the fact that the international tendency is to protect them as service marks.
